Personal Information We Collect About You
We may collect personal information (such as name, email and postal address, telephone number and financial information) from consumers, customers, job applicants, employees, contractors, vendors and other individuals through our websites or by other means (such as email, fax, postal mail or telephone). The principal ways you may provide the information and the types of information you may submit as well as the ways we may use the information, are listed below.
Business Alerts, Newsletters and Other Communications
You may be able to sign up to receive business alerts, newsletters and other communications (including emails) about our company. To sign up for these, we ask you for information such as your name and postal or email address. We use the information you provide to send you the communications and information you have requested and to communicate with you about our products and services.
Scholarships, Grants and Awards
You may be able to apply for scholarships, grants or awards offered by Koch Industries. To take advantage of this opportunity, we ask you for information such as name, contact information and other information about you and the person you nominate. We use the information you provide to select the winners and recipients of our awards, to communicate with you, and to publish a list of the recipients.
Incidents and Investigations
When you submit an incident report or provide information in connection with an investigation, we may collect details such as your name, identification number, email address and postal address. Depending on the nature of the incident or investigation, we may collect additional information as well. We use these details to follow up on the report or investigation and comply with internal and legal requirements.
You may be able to submit your resume and other information online to apply for a job with Koch Industries or its subsidiaries and affiliates. The information you provide in connection with your job search is maintained in an external database hosted by our third party service provider. We use the information you submit to evaluate your qualifications for employment and to contact you regarding possible employment opportunities with Koch Industries or its subsidiaries or affiliates. You may also choose to provide information such as your gender or ethnic background. Providing this data is optional and is not required to apply for a job with Koch Industries. This information will not be considered in evaluating candidates’ qualifications for employment with Koch Industries.
Secure Websites for Business Purposes
On our secure websites, you may be able to register to gain access to information and services related to your business relationship with Koch Industries or its subsidiaries or affiliates. To register, we may ask you for details such as your name, email address, postal address, telephone number, user id and password. We use these details to provide you with secure access to information about your business relationship with us and to facilitate your use of the websites.
You may be able to submit feedback on our websites. If you choose to give us your feedback, we may ask you for information such as your name, email address, postal address, occupation and the name of your organization. We also ask you about your experience using our websites. We may use the information you provide to enhance our websites.
You may contact us with questions, requests or comments through the "Contact Us" link on our websites or by other means (such as email, fax, postal mail or telephone). When you do so, we may ask you for information such as your name, email address and telephone number. We use the information to respond to your questions and comments. Vendors and Contractors
If you are a vendor or a contractor for Koch Industries or one of its subsidiaries or affiliates, we may ask you to provide information such as your contact information, tax identification number, date of birth, driver’s license or other identification number, or financial information to establish and administer your account or process payments, and for compliance with internal and legal requirements.
Other Uses of Information
We may use the personal information you provide to us for the internal purposes of Koch Industries and its subsidiaries and affiliates. These purposes include administration of our websites, data analytics and compliance with our legal obligations, policies and procedures.
Information We Collect by Automated Means
We collect certain information by automated means when you visit our websites, such as how many users visited our sites and the pages accessed. By collecting this information, we learn how to best tailor our websites to our visitors. We collect this information through various means such as “cookies,” “web beacons” and IP addresses as explained below.
Certain pages on our websites contain "web beacons" (also know as Internet tags, pixel tags and clear GIFs). These web beacons allow us to obtain information such as the IP address of the computer that downloaded the page on which the beacon appears, the URL of the page on which the beacon appears, the time the page containing the beacon was viewed, the type of browser used to view the page, and the information in cookies set by the third party.
An IP address is a unique identifier that certain electronic devices use to identify and communicate with each other on the Internet. When you visit our websites, we may view and/or store the IP address of the device you use to connect to the Internet. We use this information to determine the general physical location of the device and understand from what regions of the world our website visitors come. We also may use this information to enhance our websites.
Information We Share
We do not sell or otherwise disclose personal information except as described here. We may share the information you provide with our subsidiaries and affiliates. We also may share the information with service providers we have retained to perform services on our behalf. These service providers are not authorized by us to use or disclose the information except as necessary to perform services on our behalf or comply with legal requirements. In addition, we may disclose information about you (i) if we are required to do so by law or legal process; (ii) to law enforcement authorities or other government officials; or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity.

These websites may operate independently from Koch Industries and its subsidiaries and affiliates. Linked sites may have their own privacy notices or policies, which we strongly suggest you review if you visit any linked websites. To the extent any linked websites you visit are not part of the Koch Industries family of companies, we are not responsible for their content, any use of the sites, or the privacy practices of the sites.
How We Protect Personal Information
We maintain administrative, technical and/or physical safeguards to protect against loss, misuse or unauthorized access, disclosure, alteration or destruction of the information you provide.
Access and Correction
Koch Industries will provide you with reasonable access to personal information you provide to us and the ability to review and correct it, as required by law. To help protect your privacy and security, we will take reasonable steps to verify your identity, such as requiring a password and user ID for websites or asking you to confirm your provided information, before granting you access to your information.
For EEA Residents
If you are located in the EEA, you may direct us not to share your personal information with third parties, except as specified below. We do not use personal information for purposes that are incompatible with the purposes for which the information was originally collected without notifying the relevant individuals of such uses and offering an opportunity to opt out.
We may disclose personal information without offering individuals an opportunity to opt out (i) to service providers we have retained to perform services on our behalf; (ii) in the event we sell or transfer all or a portion of our business or assets; (iii) if disclosure is required by law or legal process; (iv) to law enforcement authorities or other government officials; or (v) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual illegal activity.

Koch Industries, Inc. for and on behalf of itself and Koch Companies Public Sector, LLC, Koch Company Services, LLC, Koch Agriculture Company, Reiss Remediation, Inc., Market Based Management, LLC, and Koch Financial Corporation (together “Koch Industries”) has certified compliance with the Safe Harbor privacy principles, as set forth by the United States Department of Commerce, regarding the collection, storage, transfer, use and other Processing of Personal Information (as these terms are defined below) transferred to the United States from the European Economic Area and Switzerland (collectively, “EEA”). This Policy outlines our general policy and practices for implementing the Safe Harbor privacy principles for Personal Information that we collect online and offline.
For purposes of this Policy:
“Personal Information” means information that (i) is transferred to the United States from the EEA; (ii) is recorded in any form; (iii) is about, or relates to, an identified or identifiable consumer, customer, employee (including any job applicant and current or former employee), contractor, vendor or any other relevant individual located in the EEA; and (iv) can be linked to that individual.
“Processing” means any operation or set of operations performed upon Personal Information, whether or not by automatic means, such as creating, collecting, procuring, obtaining, accessing, recording, organizing, storing, adapting, altering, retrieving, consulting, using, disclosing or destroying the information.
“Sensitive Data” means Personal Information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, criminal records, driving records or information concerning health or sex life.
Safe Harbor Privacy Principles
Koch Industries’ practices regarding the collection, storage, transfer, use and other Processing of Personal Information comply with the Safe Harbor principles of notice, choice, onward transfer, access, security, data integrity, and enforcement and oversight.
We notify relevant individuals located in the EEA about (i) the purposes for which we collect and use their Personal Information; (ii) the types of third parties to which we disclose the information (for example, service providers that Process Personal Information on our behalf); (iii) certain privacy rights the individuals may have (such as the right to request access to their Personal Information and certain choices for limiting the use and disclosure of the information); and (iv) how to contact us about our practices concerning Personal Information.
Purpose of Collection and Use of Personal Information
Koch Industries may process Personal Information to (i) respond to individual’s requests; (ii) provide, evaluate the quality of and communicate about product and services; (iii) notify individuals of and administer scholarships, grants and awards, (iv) enable the company’s service providers to perform activities on its behalf; (v) carry out and support human resources functions and activities, including employee benefits, compensation and performance; (vi) undertake compliance activities; (vii) comply with contractual and legal obligations, policies and procedures; (viii) carry out internal and external investigations; (ix) undertake administrative activities, including data analytics; and (x) fulfill other purposes described in our privacy notices.
We also may Process Sensitive Data to the extent necessary or appropriate for compliance with relevant legal or contractual obligations.
We offer individuals located in the EEA certain choices for limiting the use and disclosure of their Personal Information. To learn about the choices you may have, please review the relevant privacy notice that governs the Processing of your Personal Information by Koch Industries, as specified in the Notice section of this Policy. We do not use Personal Information for purposes incompatible with the purposes for which we originally collected the information without notifying the relevant individuals of such uses and offering an opportunity to opt out of the incompatible use, unless such use is permitted or required by applicable law.
We may disclose Personal Information without offering individuals an opportunity to opt out (i) if we are required to do so by law or legal process; (ii) to law enforcement authorities or other government officials based on an enforceable government request or as may be required under applicable law; or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity.
Onward Transfer of Personal Information
We may share Personal Information with service providers we have retained to perform services on our behalf and among our subsidiaries and affiliates. We require service providers, affiliates and subsidiaries to whom we disclose Personal Information and who are not subject to laws based on the European Union Data Protection Directive to either (i) subscribe to the Safe Harbor principles or (ii) contractually agree to provide at least an equivalent level of protection for personal information as is required by the relevant Safe Harbor principles.
Access to Personal Information
Koch Industries provides individuals located in the EEA with reasonable access to the Personal Information we maintain about them. We also provide a reasonable opportunity to correct, amend or delete that information where it is inaccurate. We may limit or deny access to Personal Information where providing such access is unreasonably burdensome or expensive under the circumstances, or as otherwise permitted by the Safe Harbor principles. To obtain access to Personal Information, individuals may contact Koch Industries as specified in the "How to Contact Us" section of this Policy. Employees should submit requests for access to their Personal Information to their local Human Resources representative.
Koch Industries maintains reasonable administrative, technical and/or physical safeguards to protect Personal Information from loss, misuse and unauthorized access, disclosure, alteration and destruction.
Koch Industries takes reasonable steps to ensure that Personal Information the company collects is relevant for the purposes for which it is to be used and that the information is reliable for its intended use and is accurate, complete and current.We depend on individuals to update or correct their Personal Information whenever necessary. Please contact us if you believe your Personal Information is not accurate or current.
Enforcement and Oversight
Koch Industries has established procedures for periodically verifying implementation of and compliance with the Safe Harbor principles. We conduct an annual self-assessment of our practices with respect to Personal Information to verify that representations we make about our Personal Information privacy practices are true and that related privacy policies have been implemented as represented.
Individuals located in the EEA may file a complaint with the KII Compliance & Ethics Department in connection with Koch Industries’ Processing of their Personal Information under the Safe Harbor principles. We will also cooperate with the following dispute resolution bodies to address individuals’ complaints regarding privacy issues (i) for complaints submitted by individuals other than our employees, we cooperate with JAMS in the U.S. in accordance with the JAMS International Mediation Rules; (ii) for complaints concerning our handling of employee Personal Information, we cooperate with the relevant EU data protection authorities. We will take steps to remedy any issues arising out of a failure to comply with the Safe Harbor principles.
